Reputation, Experience, and a Reputation for Success

You should also be aware that your DUI charge can be enhanced based on any previous DUI convictions.

If you are found guilty of a first offense DUI, the law calls for suspension of your driver's license for 90 days. If you've refused to take a breath test at the site of your arrest, your license is automatically suspended for 90 days.

A second DUI conviction translates to the revocation of your driving privileges for a year. Your third will mean three years without your license, five years for your fourth.

In terms of fines and jail time, you could receive a maximum fine of $2,100 for a first offense and a maximum one-year jail sentence for the first conviction. A second conviction carries the same jail term but increases the maximum fine to $5,100. The fine for your third DUI conviction, and fourth (a class C felony), could reach $10,100, along with a sentence of a year and a day in jail.

These mandatory sentences, by the way, are not negotiable upon conviction. Their purpose is to be applied to each kind of DUI charge and exist independently of your personal situation.

Don't let any of those worst-case scenarios happen to you. We'll work hard for your right to a decreased penalty based on your situation, but if you are facing these types of penalties, you must act immediately and call the DUI criminal defense law firm of Gulas & Stuckey in Birmingham now.
